The Essentials of India's New Data Protection Bill

Former Supreme Court Judge Discusses Importance of Privacy and Secure Data Transfer

The proposed Personal Data Protection and Privacy Bill, which was tabled in the Indian Parliament, needs to guarantee the fundamental right of privacy and have a methodology to establish a secure data flow across the border, under Section 17 of the IT Act, said retired Justice B.N. Srikrishna.

Srikrishna, a former judge of the Supreme Court of India and chairman of the Data Protection Committee, said the government needs to improve privacy laws, guarantee privacy as a fundamental right and provide clarity on the independence of the proposed data protection board in establishing cross-border data movement.

Srikrishna is chair of the Data Protection Committee that proposed a data protection framework for India. He also serves as chairperson of the Advisory Committee on Individual Insolvency and Bankruptcy.
